Aggravated rape carries a mandatory life sentence. Green was sentenced to 40 years in prison on the sexual battery charge.

Assistant District Attorney John Alford has filed a multiple offender bill against Green, who has a prior felony conviction. Under the bill, Green’s sentence could increase to from 49 to 198 years on the sexual battery charge when District Judge Martin Coady holds a hearing Tuesday, Dec. 8.

Green was charged with aggravated rape and sexual battery in January 2013, after the girl’s mother reported the incidents to police.

On two occasions, the girl was left in Green’s care, and he forced her to perform oral sex on him and touched her sexually. The girl later told her mother, who confronted Green and about a month later reported him to authorities.

During the investigation, Green confessed on video to inappropriate behavior with the girl, who is now 10.
