In what police are calling a justifiable homicide, a Pine man was shot to death early Sunday during a confrontation that erupted at the Bogalusa residence where his estranged wife was staying.

According to Chief Joe Culpepper, Jerry Duncan, 36, died of multiple gunshot wounds.

The Bogalusa Police Department got a call about a disturbance at a residence on Avenue D at 1:28 a.m. While en-route officers learned that shots had been fired.

“Duncan went to the residence where his estranged wife was staying, and a disturbance ensued,” Culpepper said.

Duncan “beat up” the woman’s current boyfriend, Frank Smith, then got in his car and was in the process of leaving the premises, but stopped, got out and advanced towards Smith again, said Culpepper.

At that time, Smith’s son, Mason Smith, 18, who is in a body brace, came out with a .22 caliber rifle and told Duncan to “Get away from my dad” and “Leave him alone.” Duncan then turned on him, according to Culpepper.

“He started to chase the kid, who could not fight, and the kid shot him multiple times,” he said. “By all accounts the kid was acting in self defense. We are classifying it as a justifiable homicide and referring it to the District Attorney’s office for further review.”

Because the incident involved a death, it will likely be turned over to a grand jury, Culpepper said.
